Terms of service

1. Who we are and what we do

FreightSonar (“we”, “us”) operates a freight platform for less-than-truckload, truckload and specialized road freight within Canada. When you book, FreightSonar is the carrier of record on the bill of lading: we contract with you for the carriage and perform it with our own equipment or through carriers we select and pay. We do not act as your agent, and the hauling carrier is our subcontractor, not your contracting party.

2. Quotes

1. A firm quote is a guaranteed all-in price for the freight as declared, valid for the period shown (normally 7 days), for pickup on or about the date requested.
2. An estimate is our best current price; a dispatcher confirms it, and only the confirmed price is binding.
3. Prices are in Canadian dollars, exclude sales tax, and are based on the pieces, dimensions, weight, commodity, service level, addresses and site conditions you declare. If the freight differs at pickup or delivery, the price is re-rated to the actual freight and any accessorial service found necessary is billable with proof (scale ticket, driver note, photo or delivery receipt).
4. The quote is the invoice unless the freight was misdeclared. We do not add hidden fees after the fact.

3. Booking and the bill of lading

1. A booking creates a shipment with a PRO and a bill of lading number. The bill of lading we generate, together with these terms and the conditions of carriage, is the contract of carriage.
2. You warrant that the goods are accurately described, lawfully shipped, properly packaged and labelled for road transport, and that dangerous goods are declared with the UN number, shipping name, class, packing group and a 24-hour emergency contact, as the Transportation of Dangerous Goods Act requires.
3. A shipment may be cancelled without charge before a driver is dispatched. After dispatch, a cancellation or a dry run is billable at the greater of the minimum charge and the cost we incur.
4. Pickup and delivery windows are targets, not guarantees, unless the quote says “guaranteed”. Transit days count business days from pickup.

4. Liability, declared value and claims

1. Our liability for loss or damage is limited to $4.41 per kilogram ($2.00 per pound) of the weight of the affected goods unless you declare a higher value on the booking and pay the applicable charge, in which case liability is limited to the declared value.
2. Notice of loss, damage or delay must be given in writing within 60 days of delivery (or, for non-delivery, within 9 months of shipment), and a claim with supporting documents must be filed within 9 months. Claims are handled under the conditions of carriage.
3. We are not liable for indirect or consequential loss, including lost profit or production, or for loss caused by an act of God, the public enemy, riot, strike, an act of public authority, the inherent vice of the goods, or an act or default of the shipper or consignee.

5. Charges and payment

1. Unless you have approved credit terms with us, charges are due at booking or before delivery, as shown at checkout. Credit accounts are invoiced after delivery, payable net of the term stated on the invoice.
2. Overdue accounts bear interest at 1.5% per month (19.56% per year), and we may hold goods under a general lien for unpaid charges as the conditions of carriage allow.
3. Disputed items must be raised within 30 days of the invoice date; undisputed amounts remain payable.

6. Accounts and the platform

1. You are responsible for the people you invite to your organization and for actions taken under their sign-in. Keep credentials confidential and tell us at once about any unauthorised use.
2. We may suspend an account for non-payment, misdeclared freight, abuse of the platform or a request from a lawful authority.
3. The platform, its rates and its content are ours; you may use them to quote and book freight for your own business, not to resell or scrape them.

7. Prohibited and restricted goods

We do not carry currency, bullion, jewellery, live animals, human remains, firearms and ammunition, household goods, or goods that are illegal to transport. Cannabis, alcohol, tobacco, pharmaceuticals and temperature-critical goods move only when declared and accepted in advance in writing.

9. Changes, law and disputes

1. We may update these terms; the version dated on this page applies to bookings made after that date.
2. These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there. The courts of Alberta have exclusive jurisdiction, subject to any mandatory provincial carriage regulation that applies to an intra-provincial shipment.
3. If any clause is unenforceable, the rest stands.
